1. Acceptance of Terms of Use

By using the digital platform smoki.rs and accepting the Rules of the Prize Contest and the Privacy Policy, the user confirms that they are familiar with and accept these Terms of Use.

2. Right to Use the Platform

The right to use the platform is granted to all natural persons of legal age with residence or habitual residence in an eligible participating market who meet the participation requirements set out in the Rules of the Prize Contest.

Persons who are not entitled to participate in the Prize Contest under the Rules are not entitled to use the platform within the Contest.

3. User Account

To use the platform, the user creates a user account by providing the required information.

The user is responsible for the accuracy, completeness and updating of the information provided, as well as for the security of their user account.

The Organizer reserves the right to restrict or disable the use of an account if it determines that inaccurate information has been provided or that the platform is being used contrary to its intended purpose, the Rules of the Prize Contest or these Terms of Use.

4. Permitted Use of the Platform

The user undertakes to use the platform in accordance with its intended purpose, applicable laws, the Rules of the Prize Contest and these Terms of Use.

5. Prohibited Activities

The following activities are prohibited:

• using false or third-party information;
• using accounts belonging to other users;
• creating multiple accounts to gain an unfair advantage;
• using photographs, content or information for which the user does not have the necessary rights;
• attempting to circumvent technical restrictions of the platform;
• using automated tools, scripts or other means to manipulate the operation of the platform;
• any activity that may compromise the security, functionality or integrity of the platform.

6. Intellectual Property

All elements of the platform, including texts, graphic solutions, visual elements, names, trademarks and other content, are protected by intellectual property laws.

Users are not permitted to use, reproduce, distribute or otherwise exploit platform content without the prior consent of the rights holder.

The user warrants that they possess all necessary rights for any content submitted through the platform and assumes full responsibility for any infringement of third-party rights.

7. Platform Availability and Limitation of Liability

The Organizer makes reasonable efforts to ensure the uninterrupted operation of the platform but does not guarantee its continuous availability.

The Organizer shall not be liable for temporary system unavailability, software errors, internet connection issues, system maintenance or any other technical difficulties that may affect the use of the platform.

8. Organizer's Right to Restrict Access

The Organizer reserves the right to take all necessary measures to protect the integrity of the platform and the Contest, including restricting or disabling access for users where there is suspicion of abuse, irregularities or conduct contrary to the Rules of the Prize Contest or these Terms of Use.

9. Complaints and Contact

Complaints and requests related to the use of the platform may be submitted to [email protected] in accordance with the conditions and deadlines specified in the Rules of the Prize Contest.

10. Final Provisions

The Organizer reserves the right to amend these Terms of Use, and users will be informed of any amendments through the platform.

Any matters not regulated by these Terms of Use shall be governed by the Rules of the Prize Contest and the applicable laws of the applicable laws.

These Terms of Use shall apply from the date of their publication on the smoki.rs platform.
